Introduction

edibu LLC (“edibu”, “we”, “us”, or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you:

  • visit our websites — edibu.com and nightgauge.dev;
  • use the Nightgauge open-source software; or
  • use an optional hosted Nightgauge service, when available.

Individual products may publish supplemental privacy notices; where they do, the supplemental notice controls for that product.

Our Websites

Information you provide

We collect personal information you voluntarily submit through our websites when you:

  • contact us through a contact or support form;
  • join a waitlist or sign up for product updates.

This information may include your name, email address, and the content of your message. We use it to respond to you, provide support, and — if you joined a waitlist or opted in — send you product updates. Every email we send for updates includes a way to unsubscribe.

Information collected automatically

Our websites are served by Cloudflare Pages. Like most websites, basic technical information (IP address, browser type, requested pages, access times) is processed by our hosting provider to deliver pages and protect against abuse. Our forms use Cloudflare Turnstile to filter automated spam; Turnstile processes technical signals from your browser for that purpose.

Service providers

We use a small number of service providers to operate our websites:

  • Cloudflare — website hosting, delivery, and spam protection (Turnstile).
  • Resend — transactional email delivery and storage of waitlist and update-list contacts.

These providers process data on our behalf and are not permitted to use it for their own purposes.

The Nightgauge Software

The Nightgauge core — the VS Code extension, CLI, SDK, and skills published at github.com/nightgauge/nightgauge — is open source and local-first:

  • It runs on your machines. No edibu account or hosted service is required, and cloud connectivity is disabled by default.
  • We never receive your source code. Your repositories, files, issues, and prompts stay on your infrastructure. Calls to AI model providers go directly from your machine to your provider using credentials you control; they do not pass through edibu servers.
  • Telemetry is opt-in and off by default. Nothing is sent unless you explicitly enable it. If you do, we receive only aggregate operational data — stage outcomes, duration and token counters, and a repository slug and issue number as correlation keys. We never collect source code, file contents, branch names, commit SHAs, issue text, file paths, secrets, or free-form input. Telemetry events are retained for at most 90 days.

The complete, versioned description of what telemetry carries, how payloads are bounded, and how to opt out lives with the source code in TELEMETRY_PRIVACY.md. If that document and this policy ever differ on a technical detail, the in-repo document is the more precise statement.

To request deletion of telemetry data associated with a paid account, email privacy@nightgauge.dev.

Hosted Services and Accounts

If you create an account for an optional hosted Nightgauge service or purchase a subscription, we collect the information needed to provide the service: your email address, account settings, and billing details. Payments are handled by payment processors; we do not store full payment card numbers. Hosted services are optional — the open-source core does not require them.

How We Use Information

We use the information described above to:

  • provide, maintain, and improve our websites, software, and services;
  • respond to inquiries and provide support;
  • send product updates you have requested, with the ability to unsubscribe;
  • understand aggregate product usage where telemetry is enabled; and
  • protect our websites and services against abuse.

We do not sell personal information, and we do not use your code or content to train AI models.

Data Security

We implement appropriate technical and organizational measures to protect personal information from accidental loss and unauthorized access, use, alteration, or disclosure. To report a security concern, see nightgauge.dev/.well-known/security.txt or email security@nightgauge.dev.

Third-Party Websites

Our websites link to third-party sites (for example, GitHub). We are not responsible for the privacy practices of those sites. Your interactions with our repositories on GitHub — issues, pull requests, discussions — are governed by GitHub’s own terms and privacy policy.

Your Privacy Rights

Depending on your location, you may have rights regarding your personal information, such as the right to:

  • access your personal information;
  • correct inaccurate information;
  • delete your personal information;
  • object to or restrict processing of your information; and
  • data portability.

Children

Our websites, software, and services are not directed to children under 13, and we do not knowingly collect personal information from them.
