Terms of Service

Introduction

These Terms of Service (“Terms”) are an agreement between you and edibu LLC (“edibu”, “we”, “us”, or “our”). They govern your access to and use of our websites — including edibu.com and nightgauge.dev — and any hosted services we operate. By accessing or using them, you agree to be bound by these Terms.

Open-Source Software

The Nightgauge core — the VS Code extension, CLI, SDK, and skills published at github.com/nightgauge/nightgauge — is licensed under the Apache License 2.0. Your use of that software is governed by its open-source license, not by these Terms. Nothing in these Terms limits the rights the Apache License grants you, and nothing in the Apache License obligates us to provide support, updates, or hosted services.

Contributions to our open-source repositories are governed by the contribution terms in the applicable repository, including its Contributor License Agreement.

Use of Our Websites and Services

License

Subject to these Terms, edibu grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use our websites and hosted services for your personal or internal business purposes.

Restrictions

You agree not to:

  • use our websites or hosted services in any manner that could damage, disable, overburden, or impair our servers or networks;
  • use any robot, spider, crawler, scraper, or other automated means to access our websites or hosted services in violation of their access controls (this does not restrict cloning or using our public source repositories under their licenses);
  • attempt to gain unauthorized access to any portion of our websites or hosted services; or
  • modify, adapt, or hack our websites or hosted services, or modify another website to falsely imply that it is associated with edibu.

Early-Access and Pre-Release Services

Hosted Nightgauge services may be offered in early access. Pre-release services may change materially or be discontinued, may contain defects, and are provided without any service-level commitment unless we agree otherwise in writing.

User Content

Ownership

You retain all rights to any content you submit, post, or display on or through our websites or hosted services (“User Content”). By providing User Content, you grant edibu a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display that content solely in connection with operating and providing our websites and services. Your source code processed locally by the open-source Nightgauge software is not User Content under these Terms — it never reaches our services.

Responsibility

You are solely responsible for your User Content and the consequences of posting or publishing it. We do not endorse any User Content or opinions expressed by users.

Intellectual Property

Our Proprietary Rights

Except for the open-source software described above, edibu and its licensors own all right, title, and interest in and to our websites and hosted services, including all intellectual property rights.

Trademarks

“Nightgauge”, “edibu”, and the associated logos are trademarks of edibu LLC. The Apache License does not grant permission to use them, except as required for reasonable and customary use in describing the origin of the software.

Feedback

If you provide edibu with any suggestions, comments, or feedback, you agree that edibu may use it without any restriction or obligation to you.

Termination

By You

You may stop using our websites and hosted services at any time.

By edibu

edibu reserves the right to suspend or terminate your access to our websites and hosted services at any time, for any reason, without notice. Termination does not affect the rights you hold in the open-source software under its license.

Disclaimer

OUR WEBSITES AND HOSTED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE OPEN-SOURCE SOFTWARE IS PROVIDED UNDER THE WARRANTY DISCLAIMER IN ITS OWN LICENSE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDIBU LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on our website. By continuing to use our websites or hosted services after those revisions become effective, you agree to be bound by the revised Terms.
